MASTERDEC TERMS & CONDITIONS
These Terms & Conditions apply to all quotations, orders, products and services supplied by Masterdec Limited.
1. DEFINITIONS
In these Terms & Conditions:
Masterdec means Masterdec Limited.
Buyer means the person, organisation or company purchasing goods or services from Masterdec.
Goods means any product, doorset, component, hardware or item supplied by Masterdec.
Services means any installation, inspection, maintenance, surveying or related services provided by Masterdec.
Order means any purchase order, quotation acceptance or instruction to manufacture products or provide services.
2. QUOTATIONS
All quotations are provided without obligation and do not constitute acceptance of an order.
Unless otherwise stated in writing, quotations remain valid for a period of 30 days from the date of issue.
Masterdec reserves the right to amend or withdraw quotations where errors, omissions or specification changes are identified.
3. ORDERS
An order shall only be deemed accepted once confirmed by Masterdec in writing.
Orders for made-to-measure, bespoke or customised products may not be cancelled once production has commenced.
The Buyer is responsible for ensuring that all dimensions, specifications, handing information, finishes, hardware selections and any other requirements supplied to Masterdec are correct prior to placing an order.
Masterdec accepts no responsibility for errors arising from incorrect dimensions, specifications or information supplied by the Buyer.
4. DIMENSIONS & SPECIFICATIONS
Masterdec manufactures products in accordance with the dimensions, specifications and information provided by the Buyer.
It is the Buyer's responsibility to verify all dimensions and requirements before placing an order.
Where dimensions, specifications or product selections are found to be incorrect after manufacture has commenced, Masterdec shall not be responsible for any associated costs, delays, alterations or replacements.
Masterdec strongly recommends that all dimensions are carefully checked prior to manufacture.
Where appropriate, professional surveying services should be utilised to verify site measurements before an order is placed.
5. PRICING
All pricing will be confirmed within the quotation or order acknowledgement.
Unless otherwise stated, prices displayed on the website are inclusive of VAT.
Masterdec reserves the right to amend pricing where specification changes, manufacturing requirements, material cost increases or genuine pricing errors occur.
6. PAYMENT TERMS
Payment terms shall be as stated within the quotation, invoice or agreed credit arrangement.
Masterdec reserves the right to withhold manufacture, delivery, services or certification documentation until payment has been received in full.
Late payments may be subject to interest and recovery costs where permitted by law.
Ownership of goods remains with Masterdec until payment has been received in full.
7. DELIVERY
Delivery dates are estimates only and cannot be guaranteed.
Masterdec shall not be liable for delays caused by events beyond its reasonable control.
The Buyer is responsible for ensuring suitable access, storage arrangements and safe unloading facilities are available at the delivery location.
Goods must be inspected immediately upon delivery.
Risk in the goods shall pass to the Buyer upon delivery.
8. INSPECTION OF GOODS
The Buyer must inspect all goods upon delivery.
Any visible shortages, damage or discrepancies must be reported immediately.
Any concealed defects must be reported to Masterdec within 48 hours of delivery.
No goods should be altered, installed or modified before Masterdec has had the opportunity to inspect and assess any reported issues.
Failure to notify Masterdec within the specified timescales may result in the claim being rejected.
9. INSTALLATION & CERTIFICATION
All products must be installed in accordance with the approved installation instructions and certification requirements.
Certification applies only when products are manufactured, supplied, installed and maintained in accordance with the approved tested specification.
Installation must be carried out by competent persons.
Unauthorised alterations may invalidate certification and affect the performance of the product.
10. WARRANTY
24 MONTH MANUFACTURING WARRANTY
Masterdec provides a 24-month manufacturing warranty from the date of delivery against defects in materials and workmanship.
The warranty is subject to:
• Correct installation.
• Routine inspection and maintenance.
• Retention of maintenance and inspection records.
• No unauthorised alterations.
• Use of approved replacement components.
Any warranty claim may require evidence that the doorset has been maintained correctly and in accordance with Masterdec recommendations.
11. MAINTENANCE REQUIREMENTS
All doorsets should be inspected and maintained throughout their service life.
Maintenance should include inspection of:
• Door leaves
• Door frames
• Hinges
• Locks and latches
• Door closers
• Intumescent seals
• Smoke seals
• Thresholds
• Glazing systems
• Ironmongery
• Signage
Any damaged or defective components should be repaired or replaced promptly using approved components.
12. RECORD KEEPING
It is the responsibility of the Building Owner, Responsible Person, Duty Holder or Property Manager to maintain inspection and maintenance records.
Records should be retained for:
• Fire door inspections
• Maintenance works
• Hardware replacements
• Repairs and adjustments
• Glazing replacements
• Component changes
• Certification-related works
Evidence of maintenance and inspection may be required to support warranty claims and demonstrate regulatory compliance.
13. ALTERATIONS & MODIFICATIONS
Masterdec doorsets are manufactured in accordance with approved and tested specifications.
Doorsets must not be altered, modified or adapted without written approval.
Examples include:
• Trimming or cutting the door leaf
• Altering the frame construction
• Replacing hardware with non-approved components
• Replacing glazing systems
• Creating new apertures or cut-outs
• Removing or altering seals
• Modifying certified components
Unauthorised alterations may affect fire performance, invalidate certification and void the Masterdec warranty.
14. RETURNS & CANCELLATIONS
Due to the bespoke nature of Masterdec products, the majority of doorsets are manufactured specifically to the Buyer's requirements.
MADE-TO-MEASURE PRODUCTS
Made-to-measure, bespoke and customised products are non-returnable and non-refundable once manufacture has commenced.
Requests for order amendments or cancellations must be submitted in writing and may only be accepted at Masterdec's discretion.
Where manufacture has already commenced, cancellation charges may apply and may include the full value of materials, labour and work completed at the time of cancellation.
Standard stock items, where applicable, may only be returned with prior written agreement from Masterdec and may be subject to restocking charges.
15. LIMITATION OF LIABILITY
Masterdec's liability shall be limited to the value of the goods or services supplied.
Masterdec shall not be liable for indirect or consequential losses including, but not limited to:
• Loss of profit
• Loss of contracts
• Business interruption
• Additional project costs
Nothing within these Terms & Conditions shall exclude liability where such exclusion is prohibited by law.
16. FORCE MAJEURE
Masterdec shall not be liable for delays or failures in performance resulting from circumstances beyond its reasonable control, including but not limited to:
• Natural disasters
• Extreme weather
• Industrial disputes
• Transport disruption
• Supplier failures
• Government restrictions
• Acts of terrorism
• Fire or flood
17. GOVERNING LAW
These Terms & Conditions shall be governed by the laws of England and Wales.
Any dispute arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
18. IMPORTANT NOTICE
Masterdec doorsets are supplied in accordance with tested and certified specifications.
Failure to:
• Install correctly
• Maintain correctly
• Retain inspection records
• Retain maintenance records
• Use approved replacement components
• Follow certification requirements
may invalidate certification, affect product performance and void the Masterdec warranty.
